2. Collection and storage of personal data, and the nature and purpose of its use
A) WHEN VISITING THE WEBSITE
When you visit our website, seaside-collection.com, the browser used on your device automatically sends information to our website’s server. This information is temporarily stored in a so-called log file. The following information is collected automatically without any action on your part and is stored until it is automatically deleted:
- IP address of the requesting computer,
- Date and time of access,
- Name and URL of the file accessed,
- The website from which the access is made (referrer URL),
- the browser you are using and, where applicable, your computer’s operating system, as well as the name of your internet service provider.
We process the data mentioned for the following purposes:
- To ensure that the website connects smoothly,
- To ensure a user-friendly experience on our website,
- Assessment of system security and stability, as well as
- for other administrative purposes.
The legal basis for data processing is Article 6(1), first sentence, point (f) of the GDPR (legitimate interest). Our legitimate interest arises from the purposes of data collection listed above. Under no circumstances do we use the data collected for the purpose of drawing conclusions about your identity.

B) WHEN SIGNING UP FOR NEWSLETTER
Provided you have given your explicit consent in accordance with Article 6(1), first sentence, point (a) of the GDPR, we will use your email address to send you our newsletter on a regular basis. To receive the newsletter, you simply need to provide an email address.

C) WHEN USING OUR CONTACT FORM
If you have any questions, we offer you the option of contacting us via a form provided on the website. You must provide a valid email address so that we know who has sent the enquiry and can reply to it. Any further details you provide are optional.
Data processing for the purpose of contacting us is carried out in accordance with Article 6(1), first sentence, point (a) of the GDPR on the basis of your voluntary consent. If contact is made for the purpose of taking pre-contractual measures (e.g. a request for a quotation), data processing is carried out on the basis of Article 6(1), first sentence, point (b) of the GDPR.
The personal data we collect when you use the contact form will be automatically deleted once your enquiry has been dealt with. If the enquiry constitutes business correspondence, a retention obligation applies to any commercial letter received, in accordance with Section 257(1)(2) of the German Commercial Code (HGB). The retention period for commercial and business correspondence under Section 147(1)(2) and (3) of the German Fiscal Code (AO) is six years.
In our contact form, we use the hCaptcha service provided by Intuition Machines, Inc, 251 Little Fall Drive, Wilmington, New Castle, Delaware. hCaptcha is used to verify whether the data entered into forms has been entered by a human or by a bot. To do this, hCaptcha analyses your behaviour on the website or based on various characteristics. This analysis begins automatically as soon as you access a part of the website where hCaptcha is enabled. For the analysis, hCaptcha evaluates various pieces of information (e.g. IP address, the length of time the visitor spends on the website or app, or the user’s mouse movements). The data collected during the analysis is forwarded to Intuition Machines, Inc. The hCaptcha analysis in ‘invisible mode’ can take place entirely in the background. Website visitors are not notified that such an analysis is taking place if no challenge is displayed to the user. Data processing is carried out on the basis of Article 6(1)(f) of the GDPR: We have a legitimate interest in protecting our website from abusive automated crawling and spam. Intuition Machines, Inc. acts as a ‘data processor’ acting on behalf of its clients, as defined in the GDPR, and as a ‘service provider’ within the meaning of the California Consumer Privacy Act (CCPA).

- the disclosure is permitted by law and is necessary, in accordance with Article 6(1), first sentence, point (b) of the GDPR, for the performance of contractual relationships with you.
4. Cookies
We use cookies on our website. These are small files that your browser creates automatically and which are stored on your device (laptop, tablet, smartphone, etc.) when you visit our website. Cookies do not cause any damage to your device and do not contain any viruses, Trojans or other malware.
Information relating to the specific device used is stored in the cookie. However, this does not mean that we thereby gain direct knowledge of your identity.

A) TRACKING-TOOLS
The tracking measures listed below and used by us are carried out on the basis of Article 6(1), first sentence, point (f) of the GDPR. We use these tracking measures to ensure that our website is tailored to your needs and is continuously optimised. We also use them to collect statistical data on the use of our website and to analyse this data with a view to optimising the services we offer you.

I) GOOGLE ANALYTICS
In order to tailor our website to users’ needs and to optimise it on an ongoing basis, we use Google Analytics, a web analytics service provided by Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter ‘Google’). In this context, pseudonymised user profiles are created and cookies (see section 4) are used.
The information generated by the cookie regarding your use of this website, such as

- Referrer URL (the page visited previously),
- Hostname of the accessing computer (IP address),
- Time of the server request,
are transmitted to a Google server in the USA and stored there. The information is used to analyse the use of the website, to compile reports on website activity and to provide other services relating to website and internet usage for the purposes of market research and the user-centred design of these web pages. This information may also be transferred to third parties where required by law or where third parties process this data on Google’s behalf. Under no circumstances will your IP address be linked to other data held by Google. IP addresses are anonymised so that they cannot be linked to you (IP masking).

6. Service providers
I) GOOGLE MAPS PLUGIN
We use a plugin from the Google Maps internet service on our website. Google Maps is operated by Google Inc., based in the USA at 1600 Amphitheatre Parkway, Mountain View, CA 94043. When you use Google Maps on our website, information about your use of this website and your IP address is transmitted to a Google server in the USA and also stored on that server. We have no knowledge of the exact content of the data transmitted, nor of its use by Google. In this context, the company denies linking the data to information from other Google services and collecting personal data. However, Google may pass the information on to third parties. If you disable JavaScript in your browser, you will prevent Google Maps from running. However, you will then also be unable to use the map display on our website. By using our website, you consent to the collection and processing of information by Google Inc. as described above.

II) YOUTUBE
The data controller has integrated YouTube components into this website. YouTube is an online video portal that enables video publishers to upload video clips free of charge and allows other users to view, rate and comment on them, also free of charge. YouTube permits the publication of all types of videos, which is why complete films and television programmes, as well as music videos, trailers and user-generated videos, are available via the website.
YouTube is operated by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. YouTube, LLC is a subsidiary of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043-1351, USA.
Each time a user accesses one of the individual pages of this website – which is operated by the data controller and on which a YouTube component (YouTube video) has been integrated – the web browser on the data subject’s IT system is automatically prompted by the relevant YouTube component to download a representation of that YouTube component from YouTube. Further information on YouTube can be found at https://www.youtube.com/yt/about/de/. As part of this technical process, YouTube and Google are informed of which specific subpage of our website is being visited by the data subject.
Provided that the data subject is logged in to YouTube at the same time, when a subpage containing a YouTube video is accessed, YouTube recognises which specific subpage of our website the data subject is visiting. This information is collected by YouTube and Google and linked to the data subject’s respective YouTube account.
YouTube and Google receive information via the YouTube component to the effect that the data subject has visited our website whenever the data subject is logged into YouTube at the same time as accessing our website. This occurs regardless of whether the data subject clicks on a YouTube video or not. If the data subject does not wish for this information to be transmitted to YouTube and Google, they can prevent this by logging out of their YouTube account before visiting our website.

III) COOKIEBOT
On our website, we use the Cookiebot consent management service provided by Cybot A/S, Havnegade 39, 1058 Copenhagen, Denmark (Cybot).
This tool enables us to obtain and manage web users’ consent to data processing on our website. The processing is necessary to comply with a legal obligation under Article 6(1), first sentence, point (c) of the GDPR and under Article 7(1) of the GDPR.
The following data is processed by cookies:
- Your IP address (the last three digits are set to ‘0’),
- Date and time of consent,
- Browser information,
- The URL from which the consent was sent,
- an anonymous, random and encrypted value used to verify the end user’s consent status.
The key and consent status are stored in the browser for 12 months using the ‘CookieConsent’ cookie.
This ensures that your cookie preference is retained for subsequent page requests. The key can be used to verify and track your consent.
If you enable the ‘Collective Consent’ service feature to allow consent for multiple websites to be granted via a single end-user consent, the service will also store a separate, random, unique ID alongside your consent.
If you consent to all bulk consent options in the service configuration, this key will be stored in encrypted form in the third-party cookie ‘CookieConsentBulkTicket’ in your browser. As a result, you consent to the use of cookies by all third parties via your browser settings.
If you have disabled ‘Do Not Track’ via your browser settings, this means that you accept all or at least certain types of cookies, but the website’s functionality cannot be fully guaranteed without the processing of these cookies.
Cybot is the recipient of your personal data and acts as a data processor on our behalf. A data processing agreement has been concluded between the partners in accordance with Article 28 of the GDPR.

7. Social Plugins
I) FACEBOOK
This website uses social plugins from the social network facebook.com. The plugins are operated by Facebook Inc. (hereinafter: Facebook), 1601 S. California Ave, Palo Alto, CA 94304, USA. The plugins are marked on our website by a white ‘f’ and link to our Seaside Collection page on Facebook. The list of Facebook plugins can be viewed here.
When you visit a page on our website that contains such a plugin, your browser establishes a direct connection to Facebook’s servers. The content of the plugin is transmitted directly from Facebook to your browser and integrated into the website by your browser. We would like to point out that we have no influence whatsoever on the scope and manner in which Facebook collects and processes data using this plugin. When the plugin is integrated, Facebook receives the information that you have accessed the relevant page on our website. If you are logged in to Facebook, Facebook can associate your visit with your Facebook account. If you use the plugins (e.g. the ‘Like’ button), information is transmitted directly from your browser to Facebook and stored there. Even if you are not a member of Facebook, it is still possible for Facebook to identify and store the IP address of your device.
The purpose and scope of data collection, as well as the further processing and use of the data by Facebook, and the relevant rights and settings options for protecting users’ privacy, can be found in Facebook’s privacy policy, as currently in force.

II) PINTEREST
On our website, we use social plugins from the social network Pinterest, which is operated by Pinterest Inc., 808 Brannan Street, San Francisco, CA 94103-490, USA (‘Pinterest’). When you visit a page containing such a plugin, your browser establishes a direct connection to Pinterest’s servers. In doing so, the plugin transmits log data to Pinterest’s server in the USA. This log data may include your IP address, the addresses of the websites you have visited that also contain Pinterest features, the type and settings of your browser, the date and time of the request, how you use Pinterest, and cookies.

9. Right to object
Where your personal data is processed on the basis of legitimate interests pursuant to Article 6(1), first sentence, point (f) of the GDPR, you have the right, pursuant to Article 21 of the GDPR, to object to the processing of your personal data, provided there are grounds arising from your particular situation or the objection relates to direct marketing. In the latter case, you have a general right to object, which we will honour without you needing to specify a particular situation.

10. Data security / email communication
10.1
During your visit to our website, we use the widely adopted SSL (Secure Sockets Layer) protocol in conjunction with the highest level of encryption supported by your browser. This is usually 256-bit encryption. If your browser does not support 256-bit encryption, we will use 128-bit v3 technology instead. You can tell whether a particular page on our website is being transmitted securely by the closed key or padlock icon displayed in the status bar at the bottom of your browser.
We also employ appropriate technical and organisational security measures to protect your data against accidental or deliberate tampering, partial or complete loss, destruction or unauthorised access by third parties. Our security measures are continuously improved in line with technological developments.
10.2 As a general rule, emails sent over the internet without additional security measures (encryption) are no more confidential than a postcard.
If you communicate with us by email without any additional measures to ensure confidentiality, we will assume that you are aware of this technical limitation and that you authorise us to reply to you by standard email as well.
BASIC ENCRYPTION BETWEEN E-MAIL PROVIDERS
However, we attach great importance to confidentiality, including in our email communications. Our provider therefore automatically offers you secure email communication via your email provider.
Our German hosting provider implements additional security measures for email communication with you. The level of security depends on whether your email provider also offers you the same security measures. You can check whether your email provider uses the latest security standards at https://dane.sys4.de. If you have any doubts about this, we can discuss alternative security measures, such as the PGP email encryption mentioned below.
Regarding the security measures in place at our provider, they state: “DNSSEC has been implemented as a security measure for email communication. In addition, DANE was introduced in 2015, representing the next logical step towards greater security. The DANE network protocol adds an extra layer of security to the SSL/TLS transport protocol, which is frequently used in email traffic. Certificates are directly linked to specific DNS records for a domain and secured via DNSSEC. This ensures that a certificate has not been replaced in the meantime and that its authenticity can be verified. Mail servers that support DANE can now enforce encrypted connections between themselves. This significantly enhances the security of email transmission.”
PGP E-MAIL ENCRYPTION
A more secure – and therefore recommended – method of encrypting data transmission is asymmetric encryption following the exchange of public keys. We are happy to provide you with our public PGP key (PGP: Pretty Good Privacy). You can use this key to encrypt messages. To ensure secure communication, you will need to install OpenPGP software on your computer. Here is a list of possible solutions for various operating systems:
